Ezy P.C. Sales (EPS) — Workshop Terms & Conditions of Service
Welcome to the Ezy P.C. Sales Service & Repair Hub. These Workshop Terms apply exclusively to diagnostic, repair, modification, and upgrade services performed on physical equipment left at our retail store or submitted for service. By dropping off, delivering, or leaving your equipment, device, or system with EPS, you acknowledge that you have read, understand, and agree to the binding terms below.
If you do not agree to these terms, please do not leave your equipment with us; no diagnostics or work will be performed, and no charges will apply.
1. Service, Diagnostics & Estimates

Scope of Work: EPS will perform all necessary diagnostics, repairs, services, or upgrades using EPS technicians and equipment. This applies to services completed in an EPS retail store, onsite, or during network consultations.

Hardware Findings: If diagnostics reveal that the issue is hardware-based, EPS will notify you with an estimate before proceeding with the repair. Faulty hardware not covered by warranty will be charged at retail cost. You acknowledge that an accurate cost estimate often requires physical hardware testing.

Client-Supplied Components: If the fault is found to be caused by a client-supplied external component (e.g., portable internet dongles, printers, external drives), EPS will rectify the issue only at the client’s expense.
2. Absolute Data Protection & Customer Responsibility

Backup Requirement: It is your sole responsibility to maintain copies of all important data and to back up your computer prior to leaving your equipment with EPS.

Data Loss Waiver: Hard disk drives and solid-state drives (SSDs) are mechanical/electronic devices that can and do fail unexpectedly. Should data become corrupt, lost, or unreadable while the device is left under the care of EPS, you completely waive any liability against EPS for that loss.

Software/Data Damage: EPS and its proprietors are not liable for any damages, costs, or expenses resulting from defects or damage to software or data residing on your computer, whether incurred during the course of service or otherwise.
3. Operating System Reloads & Software Licensing

Factory Reloads: If your device requires its operating system (e.g., Windows, Linux) to be reloaded to factory settings due to hardware or software failure, EPS is only responsible for the base operating system install.

Third-Party Applications: All non-genuine or post-purchase software (e.g., Email clients, Printer drivers, iTunes, specialized browsers, photo software, internet dongles) must be reinstalled by you. EPS is not liable for programs that cannot be reinstalled due to underlying hardware failure or historical virus infection.

Custom Software Installation: Under special circumstances and with prior approval, EPS may attempt to reload legal software as provided by yourself. All software above and beyond standard Windows installation will incur an additional charge of $50.00 per half hour for all in-store service.

Licensing Representation: If the service involves transferring information or installing software, you represent that you have the legal right to copy the information and use the software. You authorize EPS to accept the software license terms on your behalf to complete the service.
4. Payment & Title of Goods

Payment Due: Full payment for actual costs incurred and the final sum owed is due strictly upon completion of the service, prior to or at the time of device collection, unless explicit pre-completion terms have been negotiated.

Title of Goods: All parts, components, and goods remain the absolute property of EPS until payment is received in full.

Late Payments: Interest may be charged on late payments in accordance with commercial debt collection practices and applicable Queensland legislation.
5. Warranties & Exclusions

Service Warranty: EPS warrants that services will be performed in a professional and timely manner. All repair labor and servicing are warranted for a period of 30 days at the discretion of EPS.

Virus/Malware Exclusion: There is NO warranty for the removal of viruses, spyware, adware, malware, or rogue-ware. If a device is reinfected or a repeat effort is required due to user behavior or secondary infection, you will be charged again at standard service rates.

Retail Computer System Warranty: When you purchase a retail computer system from EPS, the computer system will come with a 1-year hardware-only warranty. EPS will replace faulty hardware within the warranty period. This warranty strictly excludes: Damage resulting from viruses, malware, Trojans, or related infections; System crashes caused by the user or a virus deleting crucial system files; Physical damage, user neglect, power failures, or electrical surges.
6. Product Returns

Built-to-Order Systems: Products custom-built to order are tailored specifically to your specifications and will not be accepted for return or refund.

Standard Goods: Standard retail goods will only be accepted for return subject to prior separate agreement, at the original invoicing cost less a 20% restocking and service charge, and only if returns are made in unopened, original packaging.

Return Shipping: Any return shipping to the supplier or EPS shall be at the expense and sole risk of the purchaser.
7. Risk of Unintentional Damage & Fragile Hardware

Pre-existing Vulnerabilities: The Customer acknowledges that devices (especially those that are aging, have been subjected to impact drops, overheating, or liquid exposure) often possess hidden or brittle vulnerabilities. The standard physical process of opening, diagnosing, or repairing a device can occasionally cause fragile, degraded, or poorly manufactured components to crack, break, or cease working entirely.

No Liability for Incidental Failures: EPS takes utmost care when handling client hardware. However, EPS accepts no liability for any unintentional or incidental damage to internal components, clips, plastics, or screens that occurs during standard, careful diagnostic or repair procedures if the device was already structurally or electrically compromised upon arrival.
8. Customer-Supplied Equipment Liability

If any customer-supplied accessory left with us—including DC chargers, Power Supply Units (PSUs), power adapters, or other AC-connected devices—is found to be faulty and causes an electrical outage, short-circuit, fire, or damage to any plant, equipment, tools, or premises of EPS, the customer will be held fully liable for all expenses required to repair or replace the damage caused.
9. Limitations of Liability & Australian Consumer Law

Australian Consumer Law Guarantees: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled to a refund or compensation for the drop in value.

Limitation Base: To the extent permitted by law (including the ACL), if any damage occurs while your computer or systems are left for service, EPS’s entire liability to you for damages arising from any cause whatsoever—whether due to EPS's error, negligence, or any other reason—is strictly limited to the exact amount that EPS charged you for the service.

Consequential Damages: EPS has zero liability for indirect, special, exemplary, or consequential damages. This includes, without limitation, loss of use, lost business profits, lost revenue, or down-time savings. Your sole remedy is limited to seeking a recovery of damages not exceeding the amount paid to EPS for the service.
10. Governing Law & Dispute Resolution

Jurisdiction: This agreement shall be construed under, and governed by, the laws of the State of Queensland and falls under the guidance of the Office of Fair Trading.

Binding Arbitration: In the event that any dispute arises under this agreement or concerning the service provided, both parties agree that the dispute shall be resolved through binding arbitration only. Both parties expressly waive their right to proceed with dispute resolution in a court of law.
